These Terms of Use govern your access to and use of this website. They do not govern the provision of TIA’s paid services — clients who engage TIA enter a separate Client Services Agreement which sets out the terms of that engagement, including any performance guarantee TIA may offer.

By accessing or using this website, you agree to these Terms of Use. If you do not accept them, do not use the website.

1. Changes to these Terms

We may update these Terms of Use from time to time. When we do, we will post the revised version on this website and update the “Last updated” date above. The version published on this website at the time of your access is the version that applies. Continued use of the website after changes are posted constitutes acceptance of the revised Terms.

2. Permitted use

You may use this website for lawful, personal, non-commercial purposes. You must not:

  • Copy, reproduce, republish, distribute, sell, or commercially exploit any content from the website without our prior written consent;

  • Use the website in a way that breaches any applicable law;

  • Attempt to gain unauthorised access to the website, its servers, or any connected systems;

TIA is not a financial services provider, financial adviser, tax agent, accountant, mortgage broker, or solicitor. TIA does not hold an Australian Financial Services Licence (AFSL) and is not authorised to provide financial product advice. TIA is a property buyer’s agency and operates under the property and real estate licensing framework applicable in the states in which it operates (see licence details above).

All content on this website — articles, videos, podcasts, webinars, downloadable resources, calculators, social posts, and any free or introductory consultation discussions arranged through the website — is provided for general information and educational purposes only.

Nothing on this website is intended to be, or should be relied on as:

Performance guarantee. Any performance guarantee that TIA may offer is a separate contractual commitment that applies only to clients who have signed a Client Services Agreement containing that guarantee, and only on the terms, conditions, exclusions, and measurement methodology set out in that agreement. Nothing on this website constitutes, forms part of, or varies any such guarantee, and no statement on this website should be read as offering a guarantee to website users generally or to prospective clients who have not signed a Client Services Agreement. To the extent of any inconsistency between this website and a signed Client Services Agreement, the Client Services Agreement prevails.

4. Accuracy of content

We take reasonable care to ensure information on the website is accurate at the time of publication, but we do not warrant that it is current, complete, or error-free. Information may rely on data sourced from third parties (including suburb data, market reports, comparable sales, automated valuation estimates, and economic indicators) which we do not independently verify. You should not rely solely on website content when making decisions. The treatment of third-party data for any contractual purpose (including the measurement of a performance guarantee) is governed solely by the relevant Client Services Agreement and not by this website.

5. Intellectual property

All content on the website — including text, graphics, logos, photographs, videos, audio, downloadable resources, frameworks, methodologies, case studies, and the overall look and feel — is owned by or licensed to TIA and is protected by Australian and international intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to view and download content for your own personal, non-commercial use only. No other rights are granted. You must not remove or alter any copyright, trade mark, or other proprietary notices.

If you submit content to us through the website (for example, a comment, review, or testimonial), you grant TIA a perpetual, royalty-free, worldwide licence to use, reproduce, edit, and publish that content for marketing and other business purposes. 6. Enquiries and bookings made through the website

When you submit an enquiry form, book a call, subscribe to communications, or otherwise provide information through the website, you confirm that the information you provide is true and current, that you are at least 18, and that you consent to TIA contacting you about your enquiry.

Submitting an enquiry or booking a call does not create a client relationship with TIA, and does not entitle you to any performance guarantee or other contractual benefit. A client relationship — and any guarantee — begins only if and when both parties sign a separate Client Services Agreement.

7. Marketing and electronic communications

If you opt in to receive marketing communications, you consent to TIA sending you commercial electronic messages (such as emails and SMS) in accordance with the Spam Act 2003 (Cth). Every marketing message will identify TIA and include a functional unsubscribe facility. You may withdraw your consent and unsubscribe at any time, after which we will stop sending marketing communications, though we may still contact you about an active enquiry or engagement.

8. Cookies, analytics, and advertising

This website uses cookies and similar technologies, including analytics tools and advertising or conversion-tracking pixels operated by third parties (for example, web analytics and social media advertising platforms), to operate the website, understand how it is used, and measure and improve our advertising. You can control or disable cookies through your browser settings, though some features of the website may not function properly if you do. 12. Australian Consumer Law

Nothing in these Terms of Use excludes, restricts, or modifies any rights, guarantees, or remedies you have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law, or any other law that cannot lawfully be excluded, restricted, or modified (non-excludable rights).

13. Disclaimer and limitation of liability

Subject to Section 12, and to the maximum extent permitted by law:

  • The website and its content are provided “as is” and “as available”, without warranties of any kind;

  • TIA does not warrant that the website will be uninterrupted, error-free, secure, or free of viruses or other harmful components; and

  • TIA is not liable for any loss or damage (including direct, indirect, incidental, special, consequential, or economic loss, loss of profits, loss of opportunity, or loss of data) arising from your use of, or reliance on, the website or its content, whether in contract, tort (including negligence), statute, or otherwise.

Where TIA’s liability for a failure to comply with a non-excludable right can be limited, our liability is limited, at our option, to re-supplying the relevant content or service, or paying the cost of having it re-supplied. To the extent the law permits a monetary cap on any other liability arising in connection with the website, TIA’s total aggregate liability is limited to 100 AUD.

You acknowledge that any decision you make based on information from the website is your own.

14. Indemnity

You are responsible for, and will reimburse TIA for, any reasonable loss, damage, or cost (including reasonable legal costs) that TIA suffers to the extent it is caused by your breach of these Terms of Use, your breach of any law in connection with your use of the website, or your infringement of any third party’s rights. This obligation does not apply to the extent the loss, damage, or cost is caused by TIA’s own negligence or breach, and is reduced proportionately to the extent TIA contributed to it.

15. Severability

If any provision of these Terms of Use is found invalid or unenforceable, it will be read down to the minimum extent necessary or, if that is not possible, severed, and the remaining provisions will continue in full force.

16. Governing law

These Terms of Use are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
